Malibu Paragliding Club Membership

  1. The Malibu Paragliding club ( MPC ), founded in 2003, is a non-profit Club dedicated to the growth, safety, and solidarity of the sport of paragliding. MPC is an exciting, active organization of about 25 members (growing fast), most of whom live in Southern California. Pilots of all level who are experienced in the safety measures as well as the conditions under which paragliding and powered paragliding can be its most rewarding, and who are devoted to maintaining the site as beautiful and sceanic, family members, and non-flying enthusiasts comprise our membership. We regularly hold fun and informative meetings at which everyone, members and non-members alike, are welcome. The MPC is an official chapter of our national organization, the USHPA.
    MPC also organizes many exciting events each year; fly-ins, competitions, glider displays, out-of-town flying trips, seminars, parties and picnics all provide opportunities to meet many new friends and learn more about paragliding.

    Please contact the MPC Secretary (see Club Officers ) for more information about either of these activities.

    Members of the MPC are (and are restricted to being):

  2. Pilots qualified to fly malibu with a minimum P3 rating. P2 must be guided by the local exclusive school for a minimal fee.

  3. Current USHGA members.

  4. All pilots must fly certified paraglider (DHV or ACFPUL)

  5. All paramotors must generate less than a determined by the city of Malibu decibel level

  6. Current annual members at MPC.

  7. Individuals who have paid a $30 annual fee ($50 first year) to cover expenses of the Club.

  8. The first President was elected and will serve until the first annual party.

  9. The new President will be elected at the annual party and will serve for one year.

    Responsibilities:

    The responsibilities attendant to membership in the MPC extends beyond those normally expected of Advanced, Tandem and Instructor pilots at any flying Site. They are:

  10. To encourage all pilots at the Site always to follow safety procedures.

  11. To engage, in a helpful and supportive way, with any pilot or private person who may not be following safety procedures to ensure that they do.

  12. To encourage pilots to follow specific Site rules and to engage with those who are not following Site rules in a helpful and informative way to ensure that they do.

  13. To act as a greeter of guests, interested onlookers, possible new pilots or those seeking a tandem experience, and of the general public.

  14. To represent Malibu sites as the outstanding international Site that it is.

  15. To help in the improvement of the Site through labor, financial donations, or other contributions as each pilot sees fit.

    Benefits:

    The primary benefit of being a member of the MPC is to fly with other experienced pilots devoted to this exceptional Site and to paragliding, and to promote the sport of paragliding, particularly at Malibu sites, thereby helping to ensure its continuation. Specific benefits are:

    Receipt of the newsletter, and the right to make appropriate input into it (such as information, safety comments, personal advertising, or suggestions). Invitation to the annual party held to recognize the achievements and contributions of members.
    Early notification and reservation at special events and educational seminars/classes offered by the Malibu sites staff and associates.

HOW TO PROCEED BEFORE YOUR FIRST DAY IN MALIBU?

1.... You must be guided by Claude Fiset or one of our other dedicated GUIDES before accessing any of our sites. You MUST have a P3 rating with 10 guided flights on our MPC sites before flying without supervision. If you have a P2, you can fly with the local instructor for a minimal fee depending on you expertise. You may have to show your skills on a P2 site first.

RULES


•The ceiling is @ 5000' ASL all along the coast

•DO NOT FLY MOTORIZED IN THE SADDLE PEAK AREA UNDER 3300' ASL.

•DO NOT FLY MOTORIZED OVER THE SAME AREA FOR ANY EXTENDED AMOUNT OF TIME, ESPECIALLY IF POPULATED.

•DO NOT MAKE YOUR APPROACH OVER BUILDINGS NOR THE HIGHWAY (It is against the law), INSTEAD, FLY OVER THE HIGHWAY 500' OR HIGHER AND STAY OVER THE OCEAN UNTIL THE VERY END. FAA officials are watching us!

•Do not do Aerobatic maneouvers close to shore. Instead, fly far over the ocean and go as crazy as you wish. We don't want to scare people away and of course respect the FAA rules!

•PLEASE BE CURTEOUS, KEEP YOUR DISTANCE FROM BEACH GOERS AS WELL AS BUSINESSES AND HOME OWNERS. STAY FAR FROM YOUNG KIDS ON THE BEACH.

•Flights from Saddle Peak: Try to fly far from homes, if you must fly over homes, keep a 200' or greater distance.

•THE NEW LANDING ZONE IS NOW ON THE EAST SECTION WHERE THE BEACH IS WIDER.

•Must possess a USHGA P3 rating (or possess a P2 and be guided by the local instructor) and our Club membership to access the club's sites.

•Do not drive through the gated community unless your License plate number is listed above. If you drive to the towers and you license plate number is not on the list, you will get TOWED away.

1.Corral Canyon : PLEASE DO NOT FLY WITHOUT FIRST BEING GUIDED. Visitors have been injured. Top land or land on flat below. Not on the public beach.  If you have to cross the highway, do it 500' above it.

2.Saddle Peak : We have many take offs up there covering 330 degrees but only 2 of them are open at the moment. East and South facing. Never fly alone from that site, keep it as quiet as possible and please, don't fly above homes under 500' around the Saddle Peak community (it is a FAA regulation after all!). Pilots meet at the LZ before heading up to use less vehicles. Only authorized vehicles will drive past the gate (list of cars given to caretaker of the SPPOA). LEAVE THE SPINE BEFORE YOU GET TO THE END OF IT (see picture Top of page) AT ~ 1000' ASL TO MAKE SURE YOU FLY 500' OR HIGHER ABOVE HOMES (especially the ones to the West of the towers) AND THE HIGHWAY. IT is a FAA RULE. Please land ~ 1/4 mile down from Mcdonalds and do not come back over the highway or buildings after crossing over. Destroy your altitude over the Ocean and finalize your flight nice and easy away from any bystanders.

3.Respect the neighbors!

4.Calabasas: Access through the gated community. One of our GUIDES will assist. Or, you can hike from the front, there is a nice trail on the North foothill. Please do not land at the bottom for the moment (water treatment zone). Top landing or foot hill side landing is easy.

5.Malibu Bluffs Park (Strip across from Pepperdyne University): Open for kiting and small tow flights. Access and training open to Uptimal Paragliding and/or rated pilots.

6.Deer Creek: Great for motor flights to Malibu. Do not land on public beaches (get a map to find out what is public and not). Small ridge along the access road, soarable most days of the year.

7.Point Mugu (Laguna Peak): contact John Thee or Claude Fiset to access the site. It is a military zone, please do not fly during the week, do not fly past the PCH, do not fly by to the Microwave towers (you could grow a third nipple!).

8.East of Bluffs Park: Private property. OPen for kiting.


Beach Landing: Please do not climb over any fences to get to PCH. Please use the designated Beach access across from Mcdonalds.

BYLAWS


Article 1: Name & Mailing Address
The Name of the organization is the Malibu Paragliding Club, hereafter referred to as the Malibu Paragliding Club.
The club will use 2 mailing addresses that will follow the officers:
The Secretary's preferred mailing address will accept General Business
The Treasurer's preferred mailing address will be used for:  The Bank Account, Dues, Other Contributions, and Membership Roster Business

Article 2: Purpose
The Malibu Paragliding Club is intended to serve the following purposes:
Provide representation for the membership on issues that impact paragliding activity on the Malibu Coast.
Provide services to the membership that will facilitate their flying activities.
Promote flying activities and social activities for the membership.

Article 3: Organization
The club shall be organized as a non-profit, mutual benefit club of members who choose to associate for their own benefit and the mutual benefit of the club membership. If operating cash on hand in the club treasury exceeds $1,500 for a one year period, the club will incorporate as a California non-profit, mutual benefit corporation before the end of the next calendar year.
 
Article 4: Affiliation
The Malibu Paragliding Club will be a chapter of the United States Hang Gliding club, hereafter referred to as the USHGA.
 
Article 5: Membership
The Malibu Paragliding Club recognizes the following classes of membership: Guest, Full Member, Household Member, Contributing Member, Guest Member.
Qualifications: Current USHGA membership. $50 first year fee, then $30 per year.
Dues: May be waived by a full member.  Full member should log the guest activity on the Malibu Paragliding Club web site.  Donations are encouraged and should be forwarded to the Treasurer.
Benefits & Privileges: The same benefits and privileges as a full member except they will not be permitted to vote on items of substance.
 
Full Member
Qualifications: Current USHGA membership.
Dues: $30 per calendar year.
Benefits & Privileges:  May fly from or into launch and landing sites that the club has the authority to oversee or regulate.  May participate in all club activities.  May cast one vote at the general membership meetings on items put to the general membership for a vote if they meet the voting requirements in Article 8 of these bylaws.
 
Household Member
Qualifications: Same as a full member plus another person residing at the same address must be a full member.
Dues: $30 per calendar year for the full member, $20 per year for the first household member, and $10 per year for additional household members.
Benefits & Privileges: Same as a full member.  A house hold member is considered a full member, the designation is only intended to address dues.
 
Contributing Member
Qualifications: Same as a full member.
Dues: Same as full member plus a contribution approved by the membership.
Benefits & Privileges: Will be the same as a full member plus a contributing member may cast two votes at the general membership meetings on items put to the general membership for a vote if they meet the voting requirements in Article 8 of these bylaws.
Approved Contributions: The general membership may approve any contribution to the club, at any time. The following should be considered to qualify as approved contributions:
Hosting a general membership meeting.
Serving as an club officer or director.
Chairing a committee that publishes a report.
Donating 20 hours of non physical labor on club projects.
Donating 15 hours of physical labor on club projects.
A $100 cash donation to the club treasury in addition to the regular full membership dues.
Duration of contributing member status: Members who contribute a cash donation will be considered contributing members until their membership renewal the following year. club officers, directors, and host will be considered contributing members the same calendar year they are serving. Members who's contribution is approved by the general membership will maintain their status as a contributor for the duration of the calendar year. The general membership may choose to renew contributing member status at the beginning of a new calendar year.
 
Duration of membership and payment of dues
Membership dues expire at the end of a calendar year. Dues may be prepaid through the end of the next calendar year. Full members and household members joining the club in mid year may prorate their dues for the remainder of the year, however the minimum payment to process a full membership application will be $20.
 
Termination of Membership
An individual's membership may be terminated by a 2/3 vote of the members present at the general membership meeting. Termination of membership is considered an item of substance requiring appropriate notification.
 
Article 6; Officers and Directors
Officers
The officers of the club shall have the authority to conduct business for the club, including but not limited to the expenditure of club funds and negotiating agreements in behalf of the club.
The officers shall include: a President, Vice President, Secretary, and Treasurer.
 
President: Jai Pal Khalsa
Shall be elected by a majority vote of the members present at the December general membership meeting.
Shall chair the general membership meetings as well as any BOD meetings that he or she may wish to call.
May appoint committees to work on club business.
May appoint someone to take the minutes if the Secretary is unavailable.
Shall appoint the Vice President, the Secretary, and the Directors.
Shall sign and execute all contracts in the name of the Malibu Paragliding Club.
Shall have the authority to sign checks with verbal consent from the treasurer.
 
Vice President: Craig Gordon
Shall be appointed by the President.
Shall perform the duties of the president if the president is unavailable or the president is removed from office. Should take direction from the president and assist the president.
 
Secretary: Frank Breek
Shall be appointed by the President.
Shall bring a hard copy of these Bylaws to The General Membership Meetings.
Shall keep The Minutes of The General Membership Meetings and any BOD meetings.
Shall publish draft minutes on the web site and solicit clarifications, additions, and corrections.
The Secretary may modify and republish drafts at their discretion.
Shall ask for certification of the minutes.
Shall maintain the records of the club with the exception of the membership list which shall be directly maintained by the treasurer. The secretary should have access to the membership list.
 
Treasurer: Didar Khalsa
Shall be elected by a majority vote of the members present at the December general membership meeting.
Shall maintain the club membership list.
Shall maintain the club bank account and keep possession of the club checks.
Shall have the authority to sign club checks.
May give club checks to the president and verbally authorize the president to sign those checks.
The fiscal year shall be from January 1st to December 31st. Dues will be paid no later than April 30.
 
Directors
In addition to the officers, the following positions may be appointed by the president and have the title of director: News Letter Editor, Activities Director, Flight Director, Safety Chairman and past President.
 
News Letter Editor: Shall publish a club news letter at the beginning of Spring, Summer, Winter, and Fall.
 
Activities Director: Shall have the authority to plan and schedule activities without direct ratification of the membership.

Flight Director: The Flight Committee shall establish recommended flying experience for each site, and enforce safety standards at club operated sites.

The Safety Officer: shall file accident reports, oversee and advise pilots, and perform such other duties as may be incident to the position of Safety Officer.
 
Removal of Officers or Directors
A member may be removed from office, suspended for a period to time, or expelled for cause, such as violation of any of these bylaws, or flight regulations, or other rules of the club or for conduct prejudicial to the best interests of the club. Such action shall require a two-thirds (2/3) vote of all voting members at a regular meeting, provided that a statement of the charges and a notice of the time and place of the meeting have been mailed to the member at least ____ days before the meeting, and that the member will have an opportunity to present a defense at the meeting.
 
Article 7: Meetings
A regularly scheduled general membership meeting will be held on the Saturday following the first Friday of the following even calendar months: February...
The time and place of the next general membership meeting will be decided prior to the close of the current membership meeting.
The purpose of the general membership meeting is to conduct club business and take limited comment from the membership at the discretion of the chairperson.
A special or emergency general membership meeting may be called at the discretion of the president. The party requesting the special meeting must notify all voting members who have operational voice mail as to the time and place of the meeting at least 1 day prior to the meeting.
 
Article 8: Voting
Items of substance affecting policy or procedure brought before the club membership for a vote must be presented to the membership by the sponsor in a final written form at least two weeks prior to the meeting at which the vote is to be taken. Presentation must specify the date a vote will be taken. Presentation will be considered satisfactory if the sponsor gives a copy of the proposal to the members present at a regularly scheduled general membership meeting, or Post a copy of the proposal to the appropriate Malibu Paragliding Club web site discussion page.
Items of substance affecting policy or procedure should be approved by a 2/3 vote of the ballots cast at a general membership meeting.
For items of substance affecting policy or procedure, members may also cast their ballots by e-mail addressed to Secretary@Malibupg.org or by logging on to the Malibu Paragliding Club web site and logging their vote on the appropriate page if that service is available.  Votes entered electronically must be time stamped prior to the midnight hour preceding the day the vote is scheduled to be taken.  Votes sent by e-mail should clearly indicate the voters identity and intent.
Less critical items not significantly affecting policy or procedure may be proposed and voted upon at the same meeting. Those items may be passed by a majority vote of the members present.
To be eligible to vote, participants must satisfy the following:
Must be full members, household members, or contributing members.
Must have previously attended at least two general membership meetings within the past 12 months.
Must have a current USHGA para 2 certification or higher.
Must have read the proposal if one has been presented.
Full members and household members may cast one vote per issue and contributing members may cast two votes per issue
 
Article 9: Bylaw Amendments
These bylaws may be modified or changed by a 2/3 vote of the members casting ballots at a scheduled general membership meeting. Depending on the nature of the amendment, a proposal to chance the bylaws may be considered an item of substance and may require appropriate notification.

Article 10: Operational Policy & Procedures
In addition to these bylaws, The club may develop and enact specific operational policy and procedure.

                                Subpart A--General



  Sec. 103.1  Applicability.


    This part prescribes rules governing the operation of ultralight vehicles

  in the United States. For the purposes of this part, an ultralight vehicle

  is a vehicle that:

    (a) Is used or intended to be used for manned operation in the air by a

        single occupant;

    (b) Is used or intended to be used for recreation or sport purposes only;

    (c) Does not have any U.S. or foreign airworthiness certificate; and

    (d) If unpowered, weighs less than 155 pounds; or

    (e) If powered:

    (1) Weighs less than 254 pounds empty weight, excluding floats and safety

        devices which are intended for deployment in a potentially catastrophic

        situation;

    (2) Has a fuel capacity not exceeding 5 U.S. gallons;

    (3) Is not capable of more than 55 knots calibrated airspeed at full

        power in level flight; and

    (4) Has a power-off stall speed which does not exceed 24 knots calibrated

        airspeed.




  Sec. 103.3  Inspection requirements.


    (a) Any person operating an ultralight vehicle under this part shall,

        upon request, allow the Administrator, or his designee, to inspect

        the vehicle to determine the applicability of this part.

    (b) The pilot or operator of an ultralight vehicle must, upon request of

        the Administrator, furnish satisfactory evidence that the vehicle is

        subject only to the provisions of this part.



  Sec. 103.5  Waivers.


    No person may conduct operations that require a deviation from this part

  except under a written waiver issued by the Administrator.



  Sec. 103.7  Certification and registration.


    (a) Notwithstanding any other section pertaining to certification of

        aircraft or their parts or equipment, ultralight vehicles and their

        component parts and equipment are not required to meet the airworthiness

        certification standards specified for aircraft or to have certificates

        of airworthiness.

    (b) Notwithstanding any other section pertaining to airman certification,

        operators of ultralight vehicles are not required to meet any aeronautical

        knowledge, age, or experience requirements to operate those vehicles or to

        have airman or medical certificates.

    (c) Notwithstanding any other section pertaining to registration and

        marking of aircraft, ultralight vehicles are not required to be registered

        or to bear markings of any type.



                           Subpart B--Operating Rules



  Sec. 103.9  Hazardous operations.


    (a) No person may operate any ultralight vehicle in a manner that creates

        a hazard to other persons or property.

    (b) No person may allow an object to be dropped from an ultralight

        vehicle if such action creates a hazard to other persons or property.



  Sec. 103.11  Daylight operations.


    (a) No person may operate an ultralight vehicle except between the hours

        of sunrise and sunset.

    (b) Notwithstanding paragraph (a) of this section, ultralight vehicles

        may be operated during the twilight periods 30 minutes before official

        sunrise and 30 minutes after official sunset or, in Alaska, during the

        period of civil twilight as defined in the Air Almanac, if:

    (1) The vehicle is equipped with an operating anticollision light visible

        for at least 3 statute miles; and

    (2) All operations are conducted in uncontrolled airspace.



  Sec. 103.13  Operation near aircraft; right-of-way rules.


    (a) Each person operating an ultralight vehicle shall maintain vigilance

        so as to see and avoid aircraft and shall yield the right-of-way to all

        aircraft.

    (b) No person may operate an ultralight vehicle in a manner that creates

        a collision hazard with respect to any aircraft.

    (c) Powered ultralights shall yield the right-of-way to unpowered

        ultralights.




  Sec. 103.15  Operations over congested areas.


    No person may operate an ultralight vehicle over any congested area of a

  city, town, or settlement, or over any open air assembly of persons.



  Sec. 103.17   Operations in certain airspace.


    No person may operate an ultralight vehicle within Class A, Class B,

  Class C, or Class D airspace or within the lateral boundaries of the surface area

  of Class E airspace designated for an airport unless that person has prior

  authorization from the ATC facility having jurisdiction over that airspace.


    EFFECTIVE DATE NOTE: Amdt. 103-4, 56 FR 65662, Dec. 17, 1991, revised

  Sec. 103.17 effective September 16, 1993. The text of Sec. 130.17 in effect

  until September 16, 1993 reads as follows:


  Sec. 103.17  Operations in certain airspace.


    No person may operate an ultralight vehicle within an airport traffic

area, control zone, airport radar service area, terminal control area, or

positive control area unless that person has prior authorization from the air

traffic control facility having jurisdiction over that airspace.

 


Sec. 103.19  Operations in prohibited or restricted areas.


    No person may operate an ultralight vehicle in prohibited or restricted

  areas unless that person has permission from the using or controlling

  agency, as appropriate.



  Sec. 103.20  Flight restrictions in the proximity of certain areas

  designated by notice to airmen.


    No person may operate an ultralight vehicle in areas designated in a

Notice to Airmen under Sec. 91.143 or Sec. 91.141 of this chapter, unless

authorized by ATC.

  Sec. 103.21  Visual reference with the surface.


    No person may operate an ultralight vehicle except by visual reference

with the surface.



  Sec. 103.23   Flight visibility and cloud clearance requirements.


    No person may operate an ultralight vehicle when the flight visibility or

  distance from clouds is less than that in the table found below. All

  operations in Class A, Class B, Class C, and Class D airspace or Class E

  airspace designated for an airport must receive prior ATC authorization as

  required in Sec. 103.17 of this part.

    No person may operate an ultralight vehicle when the flight visibility or
